Whats the law on taking minors across the state line without the non-custodial parents consent?
Whats the laws on a custodial parent refusing to give the name and phone number of a possible boyfriend that lives 5 hours away across the state lines in a different state(she's only met the guy one time and chatted with him online and over the phone) to the non-custodial parent? She is planning to take the children (all under the age of 7) with her on her next visit to see him and the possible boyfriend will not make the trip to see her and the non-custodial parent is not giving her consent to take the children across the state line that far away. She says she can do whatever she wants since she's the custodial parent. Please only answer if you are knowledgeable in this area of the law.
Answers:
As long as it don't interfere with the Non Custodial visitation she has the right but if the Non Custodial has asked her not to take the children and based on her going 5 hours away and verily knowing this guy, Non Custodial has grounds to modify custody and possibly take custody from the custodial parent if it were to go to court. Pending what State we are talking about here, some state laws require non custodial parents consent before leave the state with the children. I deal with issues like this all the time.
Depending on the state you live in, she could possibly be refused the right to move to another state. But I can't find any state that restricts casual travel within the US.
He is a NON-custodial parent, hello! She can take these kids to the moon if she wanted to.
What is in your divorce decree? That will set what rights the custodial parent has.
As the non-custodial parent, you generally do not have the right to give or deny consent.
You need to specify which states are concerned.
In MOST states, the non-custodial parent would have no right to interfere with such a decision.
