Should the Blackpool publican be prosecuted for allowing smoking in his pub?

smokers should be allowed their own pubs to smoke in away from anyone else, surely this is not to much to ask?

The original version of the smoking ban allowed smoking non-food pubs as per Labour's manifesto. The free vote for MPs allowed a total ban which was not what we voted for. So prosecution, no, as long as MP's are allowed to smoke in the members bar in the Houses of Parliament then the ban for the rest of us is a very bad joke. Even in Judge Dredd's 2000AD justice "Smokatoriums" were allowed for the public to go and smoke unhindered. I look forward to the first court case because sooner or later somebody will shout "Human Rights" and we know where that goes. See you at a Smokatorium near you, soon.

Good for him. If people don't want to breathe in smoke then they don't go in. I'm happy with the smoking ban in general though as it's made me much mroe social in going out to beer gardens and meeting new people.

There's a pub in Glasgow that still allows smoking - blatantly at the bar. It's pretty out the way though and is regulars only so is pretty safe from the Council/Cops.
Yes because if he is let off it will give other publicans Carte Blanche to allow smoking. I know it must be hard but we all have to abide by the law.

However, when I was little my parents ran a pub in the lake district and it used to have a smoking room just meant for smokers to use. Why can this not be the case now so that it keeps everyone happy.

Maybe what you say is right. But if it is right would it also be OK for the NHS to refuse NHS treatment to those smokers who have contracted expensive-to-treat diseases such as lung cancer, on the basis that they have "opted out" of the legal system of healthy non-smoking pubs and other public facilities.
I only smoke when Ive had a drink now. The ban has been good in a way cos Ive spoken to loads of people who I wouldnt have before. I think though it should be up to the landlord and their regulars if they want people to smoke or not. I dont see why they had to ban it anyway what about all the years gone by when people smoked in them? Non fuc*kin smokers whinging!

I am also a smoker and agree with James M above - it's the law, we (smokers) might not like it but thats the way it is now!!
if ya cant do the time dont do the crime.. smokers should have a smokeatorium were they can go and smoke them selves to death happily

A good idea but would it work, i mean if i have a favourite place and the publican allows it but i don't smoke, it means i have to go elsewhere if i want a smokefree environment.

i pay the gov huge sums of dosh to smoke so why should i not be able to smoke in a bar which

a, sells ciggies or baccy
b, has invested great sums of dosh in air filtering,
c, dont sell food
d, is full of EX smokers all complaining

i dont smoke in cafes or eating joints but give me some rights i pay more tax than you
I thought the smoking ban applied everywhere. I smoke, but would not smoke anywhere that I was asked not to! I love Blackpool, so I would assume that I can smoke on the beach freely?
No he should not! It is his Pub and I think he has every right to make his own mind up about smoking on his premises.Where the law should come in is if a landlord wants to ban smoking then he should have backing from the law.It is against his human rights to force this law on him! It is a poular law only for one group of people! Incidently,I am not a smoker.
You may have a valid point here, but they don't have them yet. The publican in question knowingly broke the law and risks the consequences. he may not allow smoking in his pub as the law stands.
Forget the pub unless it has a beer garden and it is a nice day !

We've had the ban for a while now in Scotland and I have more or less given up pubs - it's saving me a fortune ! The pubs are miserable, sanctimonious places now so why bother ?
Nope, they shouldn't have there own places. The law is the law and pubs are much nicer places because of it. The publican broke the law so he has to face the consequences

Screw him. He's just learning a very important lesson. Every law needs someone to be an example, and he's been stupid enough to set himself up as one.
I agree, unfortunately, they will make an example of him. That said, I respect what he is doing, and he is worth a thousand of the 'intolerants'. Smokers and drinkers have kept pubs. going for many years. The 'intolerants' who tend to make the most noise, probably hardly ever go into pubs.
Why should he , it's his pub ,

It's about time people stood up to the Govenment ,

Why do so few tell so many , how to live there lives , to the point that they dictate

Oh ! I forgot , they are perfect ? , they have to be obeyed , after all they think , because they say jump we have to say how high , what rubbish
They are only there because they are ment to serve us , not to abuse there positions as they do
All other publicans in the UK should do the same - it should be up to the individual owner.
