Legal question: My friend got scamed by one of those foreign emailers sending out a fake check?
He posted an ad on craigslist selling his RAM and a foreign man emailed him and said he was going to send him a check for $400. He later then said he made an error and made the check out for $4,000 and told him to send the extra money back to him. He recieved the check today and went to go cash it and got arrested.
Hes in jail now and goes to court on Thursday what do you think the verdict will be in his case?

He should be fine if he can prove it was by accident.
call Secret Service, belive it or not they handle it
guilty of stupidity.
Ignorance of the law is no excuse. Guilty.
As long as he has his evidence of the scam he should be ok.
If he passed it HONESTLY thinking it was a legit check... he's a victim of a crime... not the criminal.
But.. this scam has been around long enough... and has been publicised well enough...
What rock has he been under to not hear about it already?
Hopefully he didn't get arested AFTER sending a wire transfer to the scammer... because if he did... he's out that money. Not the bank's fault that he accepted a bad check, even if it says "cashier's check" on it. Most people don't find out it was a fake until its too late, and the bank wants their money back.
Advise him to ask his public defender to get his computer taken in evidence... and the appropriate e-mails to be printed out.
He'll get the computer back.
Why would he get arested for cashing a check?
Nigerians are crazy let me tell you! I can't go into further detail because of some stupid confidentiality agreement I signed but either way if they want to write the check for more than you want and want the money refunded or given to a "shipper" say NO! IF they call you using IP relay with some stupid excuse say NO! IF they want you to transfer money for them or say they're living in the UK just say no!!! Anyway, he can explain to them what happened and just bring up the 419 scams, talk about nigerians etc. You can even do some research yourself about 419 scams across america, they're everywhere, every day.
