Is there an online calculator to determine child support for 50/50 joint physical custody situations?
I have been divorced for 2 years and I am finally seeking child support after failing to be able to support my children without help. He makes 3 times as much money as I do and I need to know what to be prepared for in the hearing. Does the fact that I had to file for bankruptcy and lose my house in forclosure make a difference in this type of case?
Answers:
child support is normally based upon a percent of his earnings.
you will however, both have to submit Income/Expense statements and possibly past tax returns.
i remember going back to court several times for child support increases in the past.the last time i was there the judge said "Mrs. X...i don not want to see you come in for another increase again..you clearly make more money and are much more abled then him"
Ha.so that was it.but i do know it goes by percentage of income. the fact that your debts have been discharged might play into it. but here is what my attorney had told me when i was preparing my income / expense statement for the court. Expenses---Include EVERYTHING.
rent for child
gas for heating child
electric """"
gas for car to transport child
water bill to bath child / wash clothes
child care
health care
---etc etc etc you go the picture...your expenses will outweigh his.
when you are awarded child support...if he refuses to pay...get the paperwork from the state you live and also from the IRS---and they will garnish his furture refunds and return to you.
sorry - i was so long...good luck :)
its called the dissomaster, it is time scomsuming and you will have to download some software for free but is all i knwo of.
