My son had a child with a woman and she didn`t put his name on the birth certificate?
she allowed him to see the baby til she was 2 months old and then started to refuse him.. he had been to the proceciting attornys office for her to submit to paternity.. she had 2 weeks to comply and she refused.. he wants to be a father to his daughter.. he wants to pay child support.. he wants to be able to love his daughter.. other than spend 1,000.00`s of dollars on attorney fee`s what can he do.. he has a good job and health insurance..
Answers:
The only way is through the courts otherwise he's going to be screwed, every time he does something for the child there will be no records.
time to show his love with money.
go get a good lawyer, back up that talk.
He is going to have to go to court. Pay the attorney. Nothing will happen if you don't have on involved to help him.
I would verify paternity before proceeding. He can contact the prosecuting attorney to see what options he has since she did not show up.
Sounds like he needs to follow the legal route and get an attorney. If he does not have the funds for that he might look into some type of community legal aid service.
It's good he wants to be involved.
He also has rights. He can (just like in the Anna Nicole case) partition the court for father rights to include a paternity test proving he is the father. He can request visitation and get it. She can be held in contempt of court if she fails to comply with a court ordered paternity test.
he has to go to court i'm affraid.he could fone up child support and tell them he want's to pay and see if they will chase her.
Try to find out why your son's girl friend first allowed him to see the baby until she was two months old and then after that, she refused to let him see his baby. There must be some kind of misunderstanding between the two. If I were you, I will do my best to be in good terms with her (the baby's mother) and show her you care.
OK. First, the woman gets to decide whats goes on the birth certificate. The father has now say in it whatsoever. So, sorry, the name is what the momma said it is.
As for paternity, he must verify without a shred of doubt that the child is his. Your son must go to court to force a DNA test to prove the child is his or not. This will help him in so many ways.
1) The child is his, he can claim access right.
2) If the child ends up not being his, and this is established before momma seeks court ordered child support, then your son will not be supporting another man's child. This sounds like a good option to follow since the momma is already showing signs of relegating the father to the back stage anyway.
Really though, since momma is pushing daddy out of the picture, daddy has to go to court to first, prove paternity. Do not allow your son to file an affidivit of paternity without a DNA test. (unless your son is ready for the state government to turn him into a indentured servant). Then once paternity is established, the court ought to rule that daddy can have shared custody.
Unfortunately, in this day and age, don't count on momma to allow custody if she doesn't want to. Many women who flount the custody orders are never punished by the courts. There are horror stories abound where dads are labeled as deadbeat for so many reasons far beyond their control.
if he is going to go for custody he better have a lot of money a good laywer and alot of proof to back him up that she is unfit to be a mother to this child. and if he does get any custody it will be more than likely be weekends only and he will still have to pay support... is he up to that having weekends filled and paying if not he was blessed buy her not signing his name . And really is he the dad maybe she did it for reasons. also you dont know for sure what kind of man he really was to her . There must be reason behind her doing what she is doing. I have been trough this and the dad abused me hit me cussed me put me down and i did not want to put any kid through that GUESS what i have the child and he nevers sees his child
