Selling fake designer bags and shoes?
Please can someone tell me if it is possible to have an online shop sellng fake designer goods and letting the customer know its fake and not get in trouble? Or what if i showed the photos but didnt say they were gucci, chanel or prada but they could see that it was would that get me in trouble?
If i did get in trouble what would happen to me?
Answers:
That would fall under counterfeit goods as well as trademark infringement. Both of these will get you jail time as well as being sued by the companies. Even if you tell people they're counterfeit, it still has the same consequences.
in the disclamer section you state "these are not originals but copies or inspired by originals" and that should cover it..
If you are selling something that isn't the acutal designer bag as if it is the actual designer bag, you are committing fraud. Not to mention you are violating the rights of the designer/company that sells the actual items.
As long as you disclose it isn't the actual item, then you are fine in the way of fraud with the customer. But if it looks enough like the actual items the designers sell, then you could have issues with them.
Best not to do that. Either hang onto the item, or sell it in a garage sale. . .
INFRINGEMENT OF TRADE MARK OR INTELLECTUAL PROPERTY. IT IS ILLEGAL TO REPLICATE AND PROFIT FROM COPIES OF MERCHANDISE WITH OUT THE TRADE MARK OR PROPERTY HOLDERS WRITTEN CONSENT.
YES YOU WILL GET A CEASE AND DESIST LETTER FROM THE ATTORNEYS OF THE ORIGINAL PRODUCT. THEN YOU WILL GET SUED.
Sure. It's possible.
But it's illegal since it's a violation of state, federal and international trademark laws.
