How can a person be charged for statutory rape if the person is prostitute?
Answer: Statutory rape means someone involved in the act was a minor. It doesn't matter whether they're a prostitute or not. It's still against the law for someone over 18 to have sex with a minor.
Even though it happens all the time!! Sigh.
You can't be serious.
When the client/john is underage.
b/c prostitution is not a legal profession.... underage is underage.
Wow. Clueless.
If a person says No then that means no.. You don't force a plumber or an electrician if they say no. So why not a prostitute
Yes. The person is still under the legal age. Actually, you can be charged with rape even if the person is a over the age limit prostitute is the person says no. Now finding a police officer and a DA to press charges is another story (unless the perpitrator is on the lacrosse team at Duke University).
When the "client" is under age of 18
the money or service was not up to par for the one that brought up the charge,in case of a minor it does not matter who was at fault, the charge is valid.
As the law See's it. A NO is a NO. Just because a woman chooses to sell or solicit her body: does not mean that she does not have the right to say no to anyone. It is her body.
Statutory rape is defined by the age of the people involved. Whether or not prostitution is involved is irrelevant.
Do you know what statutory rape rape is?
It is an adult having sex with a minor.
Even if the minor is prostituting them self, it is still statutory rape. It does not matter if it is consensual or not.
If the it involves an adult having sex with a minor it is statutory rape.
Statutory rape laws are the same for prostitutes as they are for everybody else.
Next time drill a holey in a tree and get him pregnant ;-)
No law says that the victim of a rape has to be a virgin. Statutory rape is having sexual contact with someone who is incapable of consent due to their age. It does not matter how many times the underage person has had sex in the past, or how many times they "consented" to sex before. They are legally incapable of consent, so any adult who has had sex with them can be charged for it.
It doesn't matter if the girl is a prostitute or a willing "amateur". If she is under age and a guy has sex with her then, by definition, he is guilty of statutory rape.
Sex with a kid is still sex with a kid no matter what the circumstances are.
